What is Permitting in Real Estate?
Permitting is the process of obtaining official authorization from local government to perform construction, renovation, or demolition work on a property. Building permits ensure that work complies with building codes, fire safety standards, zoning regulations, and other local requirements. Most jurisdictions require permits for structural changes, electrical work, plumbing, HVAC installation, roofing, window replacement, and additions.
The permitting process typically involves submitting plans and specifications to the local building department, paying application fees ($100-$5,000+ depending on project scope), waiting for plan review and approval (1-12 weeks), performing work according to approved plans, scheduling inspections at key stages, and receiving a final inspection and certificate of occupancy.
When permits are required
Generally required for: structural changes (walls, foundation, roof framing), electrical panel upgrades or new circuits, plumbing modifications or new fixtures, HVAC installation or replacement, roofing, additions and new construction, window/door changes to structural openings, and deck or porch construction. Generally not required for: cosmetic work (painting, flooring, countertops), fixture replacements (faucets, light fixtures), minor repairs, and landscaping.
Unpermitted work and real estate transactions
Unpermitted work is a significant issue in real estate transactions. It can affect property value, insurability, financing (appraisers note unpermitted additions), and liability. Buyers may demand that unpermitted work be brought into compliance or negotiate price reductions. In some jurisdictions, sellers must disclose known unpermitted work. Lenders may refuse to finance properties with significant unpermitted improvements.
For flip investors, pulling permits adds time and cost but protects your investment. Permitted work increases property value, satisfies buyer and lender requirements, and provides liability protection. Unpermitted renovations, if discovered, can force you to tear out and redo completed work.
