What is a Lease Agreement?

A lease agreement (or rental agreement) is a legally binding contract between a landlord and tenant that defines the terms of the rental relationship. It specifies the rent amount, payment schedule, lease duration, security deposit, maintenance responsibilities, rules and restrictions, and the rights and obligations of both parties.

A well-drafted lease protects both the landlord and tenant by clearly establishing expectations. For rental property investors, the lease is the governing document of the tenant relationship and the foundation of your cash flow.

Essential lease terms

  • Parties: Legal names of landlord (or management company) and all adult tenants
  • Property: Full address and description of the rental unit
  • Term: Start date, end date, and renewal provisions
  • Rent: Amount, due date, accepted payment methods, late fee policy
  • Security deposit: Amount, conditions for deductions, return timeline
  • Maintenance: Landlord vs. tenant responsibilities
  • Occupancy: Maximum occupants, guest policies
  • Pets: Pet policy, deposits, breed/size restrictions
  • Termination: Early termination fees, notice requirements, eviction grounds

Fixed-term vs. month-to-month

A fixed-term lease (typically 12 months) locks in the rent and occupancy for the full term. Neither party can change terms or terminate early without penalty (unless the lease or state law provides otherwise). A month-to-month agreement automatically renews each month and can be terminated by either party with proper notice (usually 30 days). Fixed-term leases provide income stability; month-to-month provides flexibility.

Leases and investor strategy

Your lease is a risk management tool. Strong clauses protect your investment: clear maintenance responsibilities reduce disputes, late fee provisions encourage timely payment, and proper termination clauses provide legal grounds for eviction when necessary. State-specific landlord-tenant laws override lease terms that conflict, so use a lease template reviewed by a local real estate attorney.
